Your options when a deal is not cleared

This deal has not been cleared. Your options at this point are to revise and resubmit the NIL deal, cancel the deal and reject or refund any payment or benefits, or appeal the decision to a neutral arbitrator.

You can revise the NIL deal and re-submit it for review to NIL Go. Your institution’s compliance team can help you with next steps.

You can accept the decision and reject or return any payment or benefits from the Payor:

a. If you have already received payments or benefits from the Payor under the deal you submitted, you can remain eligible by returning what you received to the payor. If you do not appeal the College Sports Commission’s decision, you must return these payments or benefits to avoid issues regarding your eligibility to compete.

b. If you have not yet received any payments or benefits from the Payor under the deal you submitted, and you do not appeal the College Sports Commission’s decision, then you remain eligible only if you do not receive or accept the payments or benefits as provided in the submitted deal.

You can appeal the decision to binding arbitration with a neutral arbitrator.

You have the right to challenge this decision. To do so, you must complete the Notice of Arbitration form (attached here) within fourteen (14) days after receiving the decision from NIL Go.

a. During the 14-days you have to decide whether to challenge this decision, and during the pendency of the arbitration if you choose to challenge the decision, absent lifting of the stay by the neutral arbitrator, enforcement of any discipline imposed in connection with the violation that is subject to the arbitration shall be stayed, and you will remain eligible to practice and compete during the arbitration.

c. The decision of the arbitrator will be final and binding on both you and the College Sports Commission.
